Manufacturing Worker Case Study: $106,514 Metal Industry Settlement

A routine career in metal manufacturing resulted in a complex legal battle after years of repetitive motion and heavy lifting led to severe injuries of the shoulder, neck, and back. Despite facing conflicting independent medical opinions that initially denied the connection between her work and her physical condition, the plaintiff secured a $106,514.70 global settlement that provided for her surgeries, medical bills, and financial recovery.

Repetitive Motion and Structural Damage: The Industrial Toll

In February 2020, while working as a machine operator and warehouse packer in Park Forest, Illinois, the plaintiff began experiencing the debilitating effects of repetitive workplace activities. What started as general strains in the upper back and shoulders evolved into serious, documented medical pathologies.

The physical impact was extensive and required significant intervention:

  • Right Shoulder: A full-thickness rotator cuff tear necessitated arthroscopic repair, subacromial decompression, and glenohumeral debridement in 2021.
  • Cervical Spine: Diagnoses included cervical radiculopathy, spondylosis, and degenerative disc disease.
  • Recovery Process: The plaintiff underwent a grueling regimen of physical therapy, pain management injections, a cervical discogram, and orthopedic follow-ups.

Overcoming Conflicting Medical Opinions and Denial

The path to justice was blocked by aggressive defense tactics and contradictory medical testimony. One Independent Medical Examiner (IME) argued early on that the injuries were not work-related and that the plaintiff had already reached Maximum Medical Improvement (MMI).

Our legal team countered these obstacles by:

  • Aggressive Litigation: We filed an Application for Adjustment of Claim and a Petition for an Immediate Hearing (Section 19(b)) to address the lack of TTD payments and medical benefits.
  • Challenging Denials: We fought back against “utilization reviews” that attempted to cut off necessary physical therapy.
  • Expert Negotiation: We navigated years of disputed medical expenses, eventually resolving over $63,000 in contested medical bills as part of the final agreement.

Jack Epstein, with 30 years of experience in the Illinois legal market, steered this case through the arbitration status calls to ensure the plaintiff was not left responsible for the costs of her workplace injuries.

Turning Strategy Into Justice

By maintaining pressure on the insurance carrier through the status call and negotiation phases, we secured a comprehensive financial package. This included compensation for a 12.5% loss of use of the body regarding the shoulder and an 8% loss of use regarding the cervical spine.

Settlement That Restored Stability In April 2025, the Illinois Workers’ Compensation Commission approved a $106,514.70 global settlement. After the negotiation of medical liens and legal fees, the plaintiff received a net disbursement of $35,433.04. Furthermore, she had already received over $12,000 in TTD adjustments during the litigation process. Following successful rehabilitation, the plaintiff was able to return to her regular work in July 2022. The plaintiff paid nothing until we won the case.
